A. General Terms and Conditions for Group Bookings with FlixTrain
I. Preamble
An individual group booking with FlixTrain allows everyone in the group to travel together from a selected departure train station to a selected destination train station. The maximum group size is 100 people per coach. Depending on the size of the group and how busy the train is, the group may have its own coach or—if this is not possible or required—may be in adjacent seats in the same coach or in different coaches.
Group bookings may only be made in accordance with the FlixTrain trip schedule valid at the time of travel (see https://www.flixtrain.com); special trips, extra trips, and charter trips are not provided.
The General Terms and Conditions of Carriage of FlixTrain GmbH apply (https://www.flixtrain.com/terms-and-conditions). Deviations from these General Terms and Conditions that apply specifically to individual group bookings are defined below. These deviating provisions for individual group bookings take precedence over the other provisions that apply at FlixTrain.
II. Deviations
1. Contract Conclusion
1.1 An individual group booking enables everyone in the group to travel with a guaranteed seat each and in adjacent seats. Depending on how busy the train is, these seats may be spread across different coaches. The booking is made by one person (hereinafter “Customer”). The Customer keeps an overview of all members of the group with them during the trip and acts as the point of contact before, during, and after the trip. A contract of carriage is established with each member of the group.
1.2 The booking must be made by an adult, and at least one adult must be present on the train as a chaperone during the trip.
1.3 The contractual partner for all booked trips is FlixTrain GmbH, Friedenheimer Brücke 16, 80639 Munich, Germany (hereinafter “FlixTrain”).
1.4 The contract is concluded exclusively online as follows: Following communication regarding the current terms and conditions, the Customer will receive an offer from FlixTrain in response to their email inquiry. The period of validity of this offer will be indicated on the offer. The Customer accepts the offer by expressly confirming their acceptance in text form via email. FlixTrain reserves the right to decline group requests without specifying the reason for doing so.
1.5 The subject matter of the contract is the provision of carriage from the agreed departure train station to the agreed destination train station. If it is not possible to carry the specified number of people in the same coach for operational and/or safety-related reasons, FlixTrain shall offer either carriage by other means (e.g. splitting the group into different coaches/trains) or withdraw from the contract of carriage.
2. Invoicing
2.1 The invoice is sent electronically to the email address specified by the Customer once the offer has been accepted. The payment deadline is specified in the invoice document.
2.2 If the Customer does not make the payment by the deadline, FlixTrain reserves the right to issue an invoice for reminder fees. Furthermore, FlixTrain reserves the right to withdraw from the contract of carriage in this case.
3. Trip Cancellations
If the trip is significantly hindered, jeopardized, or adversely affected as a result of force majeure, in particular due to war, natural disasters, storms, pandemics, epidemics, public movement restrictions, travel bans, or similar events, both the Customer and FlixTrain have the right to withdraw from the contract. The legal consequences in this case are governed by the provisions laid down in law. In the event of the rescission of the contract, if services have already been provided, reference should be made to the contractual claims arising from Section 346 et seq. of the German Civil Code (Bürgerliches Gesetzbuch, BGB) and, for legal claims, to Section 812 et seq. BGB.
4. Rebooking and Cancellation
4.1 Once a booking has been made, it is only possible to make changes to the booking (rebooking) if both parties agree to this change.
4.2 The Customer may cancel the group booking free of charge at any time up to 31 days prior to the date of the planned outward journey. The cancellation must be made electronically via email.
4.3 In the event of a cancellation by the Customer between 30 and 14 days inclusive prior to the planned outbound date of the outward journey, the Customer will receive flat-rate reimbursement of 50% des vereinbarten Gesamtpreises der betreffenden Fahrt an. Dies betrifft sowohl die Stornierung der Gesamtfahrt als auch die Stornierung eines Teils der Fahrt (z.B. Hin- oder Rückfahrt).
4.4 Bei einer Stornierung, die 13 bis einschließlich 7 Tage vor dem geplantem Abfahrtsdatum der Hinfahrt liegt, fällt eine pauschale Entschädigung in Höhe von 75% of the agreed total price of the trip. In the event of cancellations less than 7 days prior to the planned outbound date of the outward journey, no refund will be provided. This applies in the case of the cancellation of the entire trip as well as the cancellation of part of the trip (e.g. the outward or return journey). The Customer has the right to demonstrate that no damage was incurred or that less damage was incurred.
5. General Obligations of Customers and Their Fellow Passengers
5.1 Instructions given by train staff must be followed.
5.2 Train staff are entitled to deny carriage to individuals who are obviously under the influence of alcohol or other drugs. The same applies to persons who endanger the safety of others for other reasons or who have a significant negative impact on the physical and emotional wellbeing of other passengers or train staff to the extent that it is no longer reasonable to continue the trip. If it is deemed necessary, train staff are also entitled in exceptional cases to terminate the trip for the entire group. There is no entitlement to alternative transportation in this case.
5.3 In the event of the extremely severe soiling of the train by the Customer or the Customer’s fellow passengers, FlixTrain reserves the right to charge the Customer for any expenses or damage incurred. The same applies in the case of damage to the train itself (internal compartment or exterior).
5.4 The communicated departure times for the train are binding for the passengers in the group booking. If the group is not at the point of departure or arrives late at the point of departure, the group will not be entitled to the reimbursement of the trip cost or to alternative transportation.
5.5 When concluding the contract, the Customer is required to provide their cell phone number or another suitable telephone number to FlixTrain to facilitate the necessary communication. The Customer shall ensure that they can be reached on this number during the trip times.
6. High-Risk Trips
If, after concluding the contract, sufficient evidence arises to indicate that the trip can be classed as a high-risk trip, FlixTrain reserves the right to withdraw from the contract. This applies in particular if, for example, the group is expected to exhibit aggressive or highly intoxicated behavior or information to that effect is received from an authority. The aim of this provision is to prevent the intended trip schedule from being jeopardized or adversely affected. If FlixTrain withdraws from the contract, the Customer will be notified immediately electronically, in text form.
